Privacy Policy

Latitude Food Allergy Care (“us,” “we,” or “Latitude”) is committed to respecting the privacy rights of its patients, customers, visitors, and other users of the services provided by Latitude, including the Latitude website located at www.latitudefoodallergycare.com (the “Site”), the Latitude mobile application (the “Application”), and other technology-enabled or personal services provided by Latitude (collectively, including the Site and the Application, referred to as the “Services”). 

We created this Privacy Policy (this “Policy”) to give you confidence as you access and use the Services, and to demonstrate our commitment to fair information practices and the protection of privacy. 

This Privacy Policy (“Policy”) describes how we collect, use, disclose and protect your Personal Information (defined below). It applies to all Personal Information processed by us in connection with or as part of providing our Services or engaging in written or electronic communications with you. However, this Policy does not describe how we collect or use your Protected Health Information (as defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”)), which is covered by our Notice of HIPAA Privacy Practices to learn about our privacy practices with respect to your Protected Health Information (as defined under the Health Insurance Portability and Accountability Act of 1996 or “HIPAA”). Latitude’s privacy policy is expressly incorporated into this Agreement by reference.  

PERSONAL INFORMATION

Personal Information is any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly with a particular individual, including, but not limited to, a first and last name, unique identifier, email address, a home, postal or other physical address, and phone number. The types of Personal Information that we may collect about you are:

a. Information You Provide to Us

We collect information you give us when you register with us for a Latitude account, when you use our Services, when you participate in surveys or promotional activities, give us feedback, or when you otherwise choose to provide your information to us.

  • When you sign up for a Latitude account we may collect your name, address, phone number, email address, race, ethnicity, title, birth date, sex, gender identification, credit card information, together with other information such as occupation and personal interests.
  • When you use our Services, such as logging into your account or speaking with administrative staff, we may collect your name, address, email address, phone number, birth date, credit card information, audio (with your permission), photos and videos (with your permission) etc., and/or request access to your microphone or camera in order to verify your identity and provide Services to you.
  • From time-to-time, we invite users to volunteer to participate in surveys or promotional activities or give us feedback. When a user participates, we request certain Personal Information such as name and email address. We may use this information to follow-up with the participants.

b. Communications from You

When you use our Services (for example on our website), complete electronic forms, or contact us, by online chat, email, phone, or text, we may automatically collect and store certain information about you and the activity you engaged in, for example: your name and contact information; information that you voluntarily provide to us; the nature of your communication; the purpose of the interaction, and the action we took in response to your inquiry or request.

c. Information Related to Your Use of the Services

We may automatically collect information about your use of the Services (we refer to this information as “Usage Data”), including information sent by your device. For example, we may collect:

  • Device information, such as your hardware model, IP address (the Internet address of your computer), unique device identifiers, and other information such as your browser type and operating system.
  • Website usage information regarding customer traffic patterns and website usage. This may include the web page that you were visiting before accessing our website or mobile application, the pages or features of our website or mobile application you browsed to inform us which part of our Site, Application and Services you visit and how much time you spend there.
  • Information about your preferences to make your use of the Site more productive through the use of cookies.

d. Information Sent by Your Mobile Devices

We collect certain information that your mobile devices send when you use our Services, such as the unique identifier, user settings and the operating system of your device, as well as information about your use of our services on your mobile device.

e. Location Information

When you use our online Services, we may collect and store information about your general location by converting your IP address into a rough geo-location, so we can, for example, provide you with information about services available in your geographic market. We may also access your mobile device’s GPS coordinates or course location, but only if you have previously agreed that we can collect this information by allowing the sharing of your location information. If you do not want us to have your location information, you may disable the location sharing feature on your device or browser.

f. Information from Our Clients and Partners

We may receive your Personal Information from our business clients and partners, such as your employer, in connection with one or more business purposes, including to make our Services available to you.

NOTICE CONCERNING CHILDREN

We do not direct any of our content specifically at children under 13 years of age. We understand and are committed to respecting the sensitive nature of children’s privacy online. If we learn or have reason to suspect that a Site or Application user is under age 13, we will promptly delete any personal information in that user’s account.

USE AND SHARING OF INFORMATION

What We Do With Collected Information

(a) Personal Information: We will not share your personal information with any third parties without your consent, except as necessary to provide you with the services offered by us or to comply with the law. We may use your personal information to verify your identity, to check your qualifications, or to follow up with transactions initiated on the Site and/or the Application. We may also use your contact information to inform you of any changes to the Site, or to send you additional information about Latitude. If you give your permission during the account registration process, we may share your contact information with our business partners or other companies so that they may send you promotional materials.

(b) Anonymous Information: We use anonymous information to analyze our Site and Application traffic, but we do not examine this information for individually identifying information. In addition, we may use anonymous IP addresses to help diagnose problems with our server, to administer our site, or to display the content according to your preferences. Traffic and transaction information may also be shared with business partners and advertisers on an aggregate and anonymous basis.

(c) Use of Cookies: We may use cookies to deliver content specific to your interests, to save your password so you don’t have to re-enter it each time you visit our site, or for other purposes. Promotions or advertisements displayed on our site may contain cookies. Cookies also help us learn which areas of our site are useful and which areas need improvement. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience at the Site may be diminished and some features may not work as they were intended.  We do not have access to or control over information collected by outside advertisers on our site.

(d) Disclosure of Personal Information: We may disclose personal information that you provide via the Services to the following third parties:

∙ Our subsidiaries, affiliates, and joint venture partners; and

∙ Contractors, vendors, and service providers we use to support our business and the Services.

We may also disclose personal information that you provide via the Services in the event of a merger, acquisition, or any form of sale of some or all of our assets, in which case personal information we collect via the Services will be among the assets transferred to the buyer. Further, we may disclose your personal information to third parties to

∙ Comply with any court order or other legal obligation;

∙ Enforce or apply our terms of use and other agreements; and

∙ Protect the rights, property, or safety of our business, our patients, clients, customers, employees, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection, information security, and other related matters.

(e) Access to Information: Unfortunately, we do not maintain any procedures for you to review or request changes to the information that we collect about you, except that you may request that we remove all information about you from our database by contacting us in accordance with this Policy. However, we are not required to comply with such requests if it is necessary for us to maintain the Personal Information in order to:

  • complete the transaction for which the Personal Information was collected;
  • detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity;
  • debug to identify and repair errors that impair existing intended functionality;
  • exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
  • engage in public or peer-reviewed scientific, historical, or statistical research in the public interest;
  • comply with a legal obligation; or
  • use Personal Information internally in a lawful manner that is compatible with the context in which a California resident provided the information and is reasonably aligned with the expectations of the resident based on the resident’s relationship with the business.

DO-NOT-TRACK POLICY

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. The Site does currently respond to DNT browser signals or mechanisms.

SECURITY

The Site has security measures in place to prevent the loss, misuse, and alteration of the information that we obtain from you, but we make no assurances about our ability to prevent any such loss, misuse, to you or to any third party arising out of any such loss, misuse, or alteration.

CENTERS FOR MEDICARE AND MEDICAID SERVICES (CMS) OPEN PAYMENTS

For informational purposes only, a link to the federal Centers for Medicare and Medicaid Services (CMS) Open Payments web page is provided here. The federal Physician Payments Sunshine Act requires that detailed information about payment and other payments of value worth over ten dollars ($10) from manufacturers of drugs, medical devices, and biologics to physicians and teaching hospitals be made available to the public.

SITE AREAS BEYOND LATITUDE’S CONTROL

Public Forums

The Site may include interactive forums such as message boards and chat rooms. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information.

Third Party Websites

The Site may contain links to other websites. If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies.
